Abstract

The book on Constitutional Basis for Building Rule of Law China is written by professor Mo Jihong, deputy director of Law Institute of Chinese Academy of Social Sciences. It depends on the achievements and experiences of constitutional implementation of the Current Constitution since 1982, and focuses on explaining the contents of ‘Comprehensively Promoting Building Rule of Law China' proposed by president Xi Jinping in his series of remarks, in the working report for the 18 thDeputies Congress of Chinese Communist Party and in the decision on several important issues concerning completely putting reform forward adopted in the third plenary session of the 18 thDeputies Congress of Chinese Communist Party in the perspective of constitutional theory, by discussing the relation between building rule of law China and guaranteeing constitutional implementation, in particular, value relation and institutional affiliation between rule of law China and rule of law state, ruling state according to law and ruling state according to constitutional law, exercising power according to law and exercising power according to constitution law, thinking in the way of rule of law and thinking way according to constitutional law etc. The author emphasizes that building rule of law China should be on the basis of constitutional implementation in order to grasp the main direction of building rule of law China based on the Constitution, and we could acquire the fixed, stable and positive results in building rule of law China by intensifying mechanism and procedure construction of constitutional implementation.

The book also focuses on appraising the results of implementing the Current Constitution systematically and deeply since 1982, and points out that it should be focused on constitutional implementation, especially underlining judicial protection of human rights and perfecting the mechanism and procedure of the People's Representative System in the process of building rule of law China so as to improve the level of constitutional implementation and lay legal foundation of building rule of law China.
